Agreement to Terms

By accessing or using the Surf mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Eligibility

You must be at least 16 years old to use the App. By using the App, you represent and warrant that you are at least 16 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

You retain ownership of content you post ("User Content"). We reserve the right to remove any content that violates these Terms or that we find objectionable in our sole discretion. We are not responsible for monitoring all User Content but may do so at our discretion.

Intellectual Property

Our Content

The App, including its design, features, graphics, and content created by us, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

Trademarks

"Surf" and associated logos are our trademarks. You may not use our trademarks without prior written permission.

Third-Party Content

Product images, brand names, and other third-party content displayed in the App belong to their respective owners. We display this content for informational purposes and do not claim ownership.

Surf Is Not a Retailer

Surf does not sell products. We are a discovery platform that helps you find fashion items from third-party retailers. All products displayed in the App are sold by independent retailers, not by Surf. We do not hold inventory, process orders, or handle fulfillment.

When you tap "Buy" or similar buttons, you will be redirected to the retailer's website to complete your purchase directly with them. Any transaction you make is solely between you and that retailer, and is subject to their terms, policies, and customer service.

Product Information

Product information, images, prices, and availability are sourced from third-party retailers. We display this information for reference and comparison purposes under principles of fair use. We strive for accuracy but do not guarantee that all information is correct, complete, or current. Prices and availability may change without notice.

Trademarks and Product Images

All product images, brand names, logos, and trademarks displayed in the App remain the property of their respective owners. We use this content under nominative fair use to identify and reference products for informational purposes. Our display of these materials does not imply any affiliation with, endorsement by, or sponsorship by the trademark owners.

Affiliate Relationships

We may in the future participate in affiliate programs with retailers, which means we may earn commissions from qualifying purchases made through links in the App. If we do, this will not affect the price you pay, and any affiliate relationships will not influence which products are displayed or how they are ranked.

The App contains links to third-party websites and retailers. We are not responsible for the content, products, services, privacy practices, or customer service of third parties. Your interactions with third-party sites are governed by their respective terms and policies.

No Endorsement

The display of any product, brand, or retailer in the App does not constitute an endorsement, recommendation, or guarantee by Surf. We do not verify the quality, safety, authenticity, or legality of products displayed. Users should conduct their own research before making purchasing decisions.

We are not responsible for the quality, safety, or legality of products offered by third-party retailers.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SURF, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR GOODWILL, ARISING FROM:

Dispute Resolution

Governing Law

These Terms shall be governed by the laws of England and Wales, without regard to its conflict of law provisions.

Informal Resolution

Before filing a legal claim, you agree to try to resolve the dispute informally by contacting us at legal@surffashion.app.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the LCIA Arbitration Rules. You agree to waive any right to a jury trial or class action.

Service Modifications

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

Feedback

If you provide us with any feedback, suggestions, or ideas regarding the App ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback without any obligation to you.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may delete your account at any time through the App settings.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Surf regarding the App.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

We may assign our rights and obligations under these Terms. You may not assign your rights or obligations without our written consent.

If you downloaded the App from the Apple App Store, you acknowledge that:
